By downloading, accessing, or using the Vivanta mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Vivanta App.

Vivanta provides users with digital health assessments based on digital biomarkers, lifestyle factors, and other health-related data. The App aims to help users understand their health and take action to improve their well-being. These services are subject to change at our discretion.


3. User Registration

To access certain features of the App, you may be required to register and provide personal information. You agree to provide accurate and up-to-date information and update it as necessary to maintain its accuracy.


4. Medical Disclaimer

Vivanta does not provide medical advice, diagnosis, or treatment. The health assessments and insights provided by the App are for informational purposes only and should not be considered a substitute for professional medical consultation. You should always seek advice from a qualified healthcare provider before making any decisions related to your health. Vivanta is not responsible for any health-related actions taken based on the information provided by the App.


5. User Responsibilities

  1. Content: You are responsible for any data or content you upload to the App, including ensuring that you have the right to do so and that the content does not infringe on any third party’s rights or violate any laws.
  2. Conduct: You agree not to use Vivanta for any unlawful purpose or in any way that could damage, disable, or impair the service.
  3. Compliance: You are responsible for complying with all applicable local, state, national, and international laws and regulations regarding your use of the App.

10. Limitation of Liability

Vivanta Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of Vivanta.


11. Modifications to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App following such modifications signifies your acceptance of the revised Terms.


12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to a violation of these Terms.

These Terms shall be governed by the laws of Delaware without regard to its conflict of law provisions.
